Air Canada court ruling sees former Aveos maintenance workers aim for $100M in compensation

Judge decided on formula to calculate damages for 2,200 former employees in Montreal, Winnipeg, Mississauga
Air Canada could have to pay more than $100 million in compensation to workers who lost their jobs at maintenance centres more than a decade ago, say lawyers in a class-action suit.
A 2022 ruling in Quebec Superior Court found the airline violated federal law by failing to keep three centres operational when Aveos Fleet Performance Inc. — the contractor that ran them — collapsed in 2012.
Air Canada has filed an appeal, which has not yet been heard.
This week, the judge decided on a formula to calculate lost wages and other damages for the 2,200 former employees of the shuttered Aveos plants, located in Montreal, Winnipeg and Mississauga, Ont.
The compensation will likely top $100 million — at least $45,400 per employee — said Elodie Drolet-French, a lawyer representing the workers. [...]

Former fashion mogul Peter Nygard has been sentenced to 11 years in prison for sexual assault convictions in Toronto from the ’80s to mid-2000s.
The sentence was handed down on Monday by Justice Robert Goldstein, nearly 10 months after Nygard was convicted in November 2023 of four counts of sexual assault but acquitted of a fifth count as well as one count of forcible confinement.
He will also have a 10-year weapons prohibition, a DBA order and he will be on the sex offender registry for 20 years.
Nygard has 6.7 years left to serve on his sentence after pre-sentence custody. Justice Goldstein said Nygard will be eligible for day parole in 21 months and full parole in 27 months from now.
Nygard was a fashion tycoon and once helmed a successful women’s fashion company. He was accused of sexually assaulting multiple women at his Toronto headquarters from the 1980s to the mid-2000s.
The 83-year-old was wheeled into the courtroom in a wheelchair with a black hoodie pulled up over his head. He has a long beard and a paper visor under his hoodie to shield his eyes from the light.
“Mr. Nygard is a sexual predator,” Justice Goldstein said during the sentencing.
Goldstein spoke to how some of the women testified that they told family or friends about the sexual assaults but didn’t go to police because they were advised it would be “her word against his” and they would not be believed. “He was a rich and powerful man,” Justice Goldstein said.
Due to a publication ban, the identities of the complainants are protected and cannot be revealed.
Five women had testified that they were invited to Nygard’s headquarters at 1 Niagara St. in Toronto under pretexts ranging from tours to job interviews, with all encounters ending in a top-floor private bedroom suite where four of them were sexually assaulted.
Multiple complainants told the jury similar stories of meeting Nygard on a plane, at an airport tarmac or at a nightclub and then receiving invitations to come to the headquarters. All five women said their meetings or interactions with Nygard ended with sexual activity that they did not consent to.
One of the complainants testified that Nygard wouldn’t let her leave his private suite for some time, which led to the forcible confinement charge. Others also testified about feeling trapped in the suite, describing doors that had to be opened with a keypad code or the push of a button near the bed.
Nygard’s latest lawyer was seeking a six-year sentence minus pre-sentence credit, citing his age and health issues, while prosecutors had asked for a sentence of 15 years.
“While he has deteriorated in custody, I do not agree that his deterioration is because of harsh conditions in custody, ” Justice Goldstein said, adding he is skeptical of Nygard’s self-reporting. “While he has health problems, he is also prone to hyperbole and exaggeration.”
Nygard was first arrested in Winnipeg in 2020 under the Extradition Act after he was charged with nine counts in New York, including sex trafficking and racketeering charges.
The federal justice minister at the time had said Nygard would be extradited to the U.S. after the cases against him in Canada were resolved.

Chapter 30 - You’re My Safe Place 
Michelle was watching her father carefully, her eyes narrowed as her father was preparing himself some salad that was on the table. Ty was eating a piece of bread while Michelle’s mother was bringing out the dinner. Mat sat next to Michelle and was holding her hand, by the way she was squeezing his hand.. He knew Michelle was on edge with her father. “So Mat, how’s life in New York?” Tom asked as he was getting the salad dressing and Mat smiled a bit “I honestly love it, there’s always something to do and I’ve been happy with my team, friends and Michelle” He said. Tom nodded and looked at Mat “We live in a small neighborhood, Michelle went to school with the same kids since she was in diapers. At first when she was moving to New York, her mother was worried so much but I wasn’t” He said and Mat nodded “You must have had a ton of faith in her” He said Tom narrowed his eyes “I didn’t think she would make it, and would be back home a couple of months in but she ended up being successful” He said and Michelle gave him a cold look and her father shrugged “I’m being honest” Mat sensed the heavy tension in the air and he coughed “Mrs. Wilson this food is amazing” He said as Mary sat down and let out a breath “I made Michelle’s favorites, it’s been a while since she’s been home and I know how much she loves my Mac and Cheese.” Michelle smiled softly “Thank you so much Mom, this is amazing” She said and her mother smiled “I’m glad you’re enjoying it sweetie” Ty looked over at Mat “My friends watched the World Juniors, they were proud to see you and the team.” He said and Mat nodded “You’re a fan of hockey?” He asked and Ty chuckled “A bit, I prefer writing and stuff.. I wrote for the school’s newspaper..” He said but he caught his father’s glare and he coughed “But I’m going to America for Harvard for Law” He said Michelle sat back “I remembered when I was becoming a doctor” She said and Mat grinned “A doctor” He simply said 
Michelle grinned at him “I watched Doctor Who as a child and always liked the Doctor.. He saves lives and I was like: ‘Wow I would like to do that too’ and I went to school” Tom watched with narrowed eyes and he coughed “You would have became one too if you didn’t quit” Michelle looked at her father and scoffed “Well I didn’t become a doctor, wanna say anything else while we’re here” Tom looked up at his daughter with a cold expression and he nodded “Actually I do” He said as he slammed the fork on the table. Ty, Mary and Mat jumped a bit but Michelle kept her ground and looked back at her father with a cold look “You were supposed to become a doctor and stay here in Winnipeg.. You were supposed to settle down and have a husband and kids and have a nice little house here. You weren’t meant to leave us and become a fucking model, do you know how many times someone comes up and shows me pictures of you? Sometimes with a swimsuit or underwear and a bra? You’ve made us look like a joke and you disrespect your mother and I by taking these gigs and going out and partying?” He said as he shook his head “I didn’t even want you with a hockey player, I wanted you to be with a lawyer or a doctor.” Tom said through gritted teeth which caused Mat’s eyes to go wide at the confession “I’m sometimes ashamed that you’re my daughter” Tom said and Mat looked over at Michelle who had tears coming down her eyes, she was very angry and she got up “Well guess what? I’m fucking happy with what I’m doing. You think that being a celebrity is so horrible but guess what? I used my platform respectfully and for good. I could care less that you’re embarrassed or ashamed of me.. Because I’m gonna leave this house with a boy I’m so madly in love with, and he’s been the best thing to happen to me in my 21 years of life. You’ve been an embarrassment of a father with everything you've done.. And I’m done with it” She said getting up and Tom got up and his plate and stuff nearly fell off the table and Mary flinched while Ty was frozen in shock. It was Mat who stood up quickly and was ready to step in but Michelle grabbed his arm and squeezed it. Mat saw she looked over at a liquor table and his eyes narrowed a bit and shook his head “We’re leaving, I’m taking Michelle out of here and we’re never returning here, and we’re gonna go back on a plane and we’re gonna go on and live our lives in New York.” Tom watched as Mat took Michelle’s hand and led her away, he didn’t move or anything but sat back in his chair. and he called loud enough for Michelle to hear  “One day you’re gonna crash and burn.. Then you’re gonna become the thing you hate the most.. Me”   Michelle tried not to let out a sob as Mat opened the door and they were outside of the house and Mat brought her into a tight hug and he kissed the top of her “I’m sorry babe” He whispered and she cried “I’m sorry I brought you to meet them.. I should have just told them to stay away from you” She whispered and he cupped her cheeks “They didn’t give you a choice, and it’s not your whole family.. It’s your father. Your mom and brother love you, I see the looks they give you and it’s the same look my family gives me.. They love you and are proud of you” Michelle sniffled and she nodded and she let out a shaky breath “Let’s go back to the hotel.. I need some sleep before you leave and I return to New York” Mat smiled softly “Of course, I’m getting tired too” The two were walking to car until they heard a shout of ‘Michelle!’ and they turned back to see Mary running with Ty behind them. The two stopped and Mary came and hugged her daughter tightly and Michelle returned the hug and Mary cried “I”m so sorry baby.. I’m sorry” Michelle let go of her mother “It’s not your fault, it’s his” She whispered and Mary kissed her daughter on the cheek “I’m not expecting you to come back home.. But I just wanna say that you’re my baby.. You’re always going to be” She said and Michelle had tears coming down her eyes “I love you so much Mom, one day You’re coming to live with me.. You and Ty” Mary nodded and smiled softly “No matter what he says.. I’m proud of you, everything that you’ve done.. You’re my little star, you’ve always been” She said and she turned to Mat “And you made a great choice in a boyfriend, he treats you so well.. Don’t let this one go” She said as Mat smiled and hugged Mary and Michelle chuckled “Trust me, I won’t be any time soon” Ty went to his sister and hugged her “I love you sis, we’re proud of you and always rooting for you.. And keep living your dream” Ty said and Michelle nodded “We’re gonna get you into your dream school Ty, screw the Harvard bullshit.. I’m gonna pay for whatever school you wanna go to.. Screw dad’s money” Ty smiled softly at that “I would love that sis” Michelle looked over at the house and looked at her two family members “We need to get back to the hotel.. I’ll call you soon Mom, call me if anything” She said as she hugged her mother and brother bye. Mat hugged the two goodbye as well. Mat and Michelle got into the car and Mat started the car and drove off, Michelle looked back and saw her mom and brother watching her, waving. Michelle had tears in her eyes and Mat took her hand and squeezed it and she sighed “Thank you Mat..” She whispered and Mat took her hand  “Emily, Tito.. Marie when she’s not scary.. They’re your family too..” Mat whispered and he looked at her for a second “I’m your family too”

the  nolans  have  always  lived  in  port  harbour  .  they  are  not  ,  by  any  means  ,  one  of  the  richest  families  ---  or  a  family  name  a  local  would  automatically  associate  with  wealth  --  but  a  well  known  name  around  town  none  the  less  .  throughout  history  ,  nolan  men  have  been  hard  workers  ,  mostly  lawyers  and  notary  publics  ,  and  the  women  have  made  advantageous  marriages  that  have  connected  the  family  to  more  influential  families  .   
that  is  until  patrick  nolan  .  only  son  out  of  four  children  .  he  studied  law  in  a  prestigious  canadian  university  ,  and  after  graduation  had  a  guaranteed  job  in  his  father ‘ s  practice  .  not  very  long  after  ,  he  got  bored  of  the  same  small  town  cases  ---  and  quit  right  before  being  made  partner  .  he  wanted  more  ,  and  left  for  the  big  city  .
the  prodigal  son  returns  .  patrick  nolan  came  back  to  port  harbour  ten  years  later  in  a  dying  car  ,  with  two  suitcases  ,  a  pregnant  wife  and  a  five  year  old  .  he  lost  his  job  as  a  lawyer  in  winnipeg  ,  and  the  search  for  another  one  was  fruitless  . .despite  his  sisters ‘  annoyance  ,  he  is  received  with  open  arms  and  is  able  to  put  bread  on  his  family ‘ s  table  .
scott  nolan  grows  up  in  a  happy  home  .  with  barely  any  memories  of  life  in  winnipeg  .  shortly  after  their  arrival  to  port  harbour  ,  margaret  gives  birth  to  a  beautiful  baby  girl  ,  rebecca  .  
scott  nolan  grows  up  in  the  tradition  of  the  nolan  family  .  he  goes  with  his  father  to  work  whenever  possible  ,  and  when  he  is  old  enough  ,  he  works  there  in  the  summers  .  as  a  copy  boy  /  coffee  boy  .  “ gotta  start  from  the  bottom  if  you  want  them  to  respect  you  when  you ‘ re  at  the  top  “ his  father  used  to  say  .  rebecca  always  pouty  at  home  ,  because  patrick  never  took  her  .
truth  is  ,  scott  nolan  has  no  interest  in  being  a  lawyer  .  he  has  never  wanted  to  be  a  lawyer  .  he  doesn ‘ t  really  have  the  character  that  it  takes  .  plus  ,  he  has  known  what  he  wants  to  do  with  his  life  since  he  was  ten  years  old  ,  and  his  dog  chester  passed  away  in  the  car  ,  on  the  way  to  the  nearest  vet  ---  which  was  a  couple  of  towns  over  .  he  wants  to  open  his  own  vet  clinic  in  port  harbour  .
when  scott  is  twenty  two  ,  his  father  passes  away  due  to  health  complications  .  he  leaves  the  house  to  rebecca  ,  and  the  firm ‘ s  offices  downtown  to  him  .  he  sells  the  office  building  to  his  oldest  cousin  ,  who  had  been  made  partner  by  patrick  before  his  passing  . 
with  that  money  ,  he  pays  his  way  through  vet  school  .  he  juggles  school  ,  and  a  job  at  a  vet  clinic to  save  up  .  after  graduating  vet  school  he  is  offered  a  full  time  job  at  the  vet  clinic  in  toronto  ,  and  he  takes  it  .  he  is  happy  commuting  ,  and  at  his  job  .  but  in  the  end  ,  he  remembers  his  purpose  .  to  open  a  clinic  in  port  harbour  . 
he  only  opened  his  own  clinic  two  years  ago  .  it  is  also  in  down  town  ,  in  a  smaller  locale  across  the  street  from  where  the  law  practice  is  .  he  names  it  paw  &  order  .

margaret  nolan  has  never  been  the  same  after  patrick  passed  .  scott  visits  her  every  other  day  ,  and  at  least  once  a  month  ,  she  urges  him  to  find  a  girl  .  get  married  .  give  her  grandkids  .  truth  is  ,  he  wants  that  .  he  just  hasn ‘ t  found  the  one  .  
despite  his  mother ‘ s  wishes  ,  the  cousin  that  kept  the  law  firm  is  currently  looking  into  changing  the  name  of  nolan  &  nolan  ,  since  there  are  no  nolans  . 
rebecca  is  now  in  law  school  .  she  is  actually  doing  really  well  ,  and  has  an  internship  in  the  city  for  the  summer  .  her  plans  are  to  come  back  to  harbour  so  there  is  actually  a  nolan  at  nolan  &  nolan  .
